#DadvsAdani Judgement Day
On Friday 6 Dec Justice Brown will deliver a vital judgment in the Supreme Court case Adani has imposed on Ben Pennings and his family for over 4 years.
Four years ago Adani launched an all out attack against Brisbane based community activist and father Ben Pennings in an attempt to silence dissent and shut down campaigns to protect communities and the environment from Adani’s destructive coal mine.
Adani secretly sought court orders to raid Ben’s family home and hired a private investigator to follow and photograph him and his family, including his 9-year-old child. And since then they have aggressively pursued damages in a civil suit which threatens Ben’s family home in Brisbane.
On Friday 6 Dec, Justice Brown will rule whether Adani’s case against Ben is completely thrown out as an ‘abuse of process’. Alternatively she will rule:
- Whether to strike out some or all of Adani’s claims against Ben, and whether after 4 years Adani can re-plead its case.
- Whether previous cost orders are permanently stayed after Adani dropped a key allegation after 3 years in court.
- Whether the Court should lift the injunction against Ben Pennings after 4 years.
